Legal Policies

La!ita – herbal vitalé

These policies apply to purchases directly from La!ita through lalitashop.com and WhatsApp. Last updated: 21 October 2026. This version applies prospectively and takes precedence over older wording on our website if inconsistent, without reducing mandatory rights or rights under existing orders.

Terms of sale and website use

Last updated: 21 October 2026

Who we are and what we sell

These terms govern purchases from La!ita – Herbal Vitalé at lalitashop.com. Our published business contact details appear below. These terms apply to purchases directly from us, including WhatsApp orders. OUR PRODUCTS comprises Her Tonic, His Tonic, LaSuger and La Tiba herbal ointment. We also sell selected complementary products. Each listing identifies the product, quantity, price, material characteristics and relevant use and safety information.

Ordering and payment

You must be at least 18 or have a parent or legal guardian place the order. Before paying, check your basket, delivery address, total price and delivery estimate. You may correct mistakes or withdraw before placing the order. For WhatsApp purchases we provide an order summary and these policies before requesting payment.

An automated receipt acknowledges your order. We accept it when we send an express acceptance or dispatch confirmation. If payment is taken but we cannot accept or fulfil the order, we notify you and refund the payment as required by law. We do not substitute products without your agreement. We retain order records for lawful business purposes; contact us for a copy of your order confirmation or invoice.

Prices are in South African rand unless clearly stated otherwise. Applicable taxes, delivery charges and other unavoidable charges are disclosed before payment. We charge VAT only where legally entitled to do so. Payment methods available for your order are shown at checkout or in your written order summary. A pricing error is addressed fairly under applicable law; it does not give us an unrestricted right to cancel an accepted order.

Supplier fulfilled goods and external stores

Some products may ship directly from a supplier or in separate parcels. Where you buy from La!ita, we remain your contact for fulfilment, complaints and applicable remedies. Supplier terms cannot reduce your rights against us. Purchases completed independently on an external website are with the seller identified there; we disclose any affiliate relationship where relevant.

Fair use and intellectual property

Do not misuse the website, attempt unauthorised access, commit fraud or submit unlawful content. Our original branding, images and text are protected by applicable intellectual property law. You may use the website for personal shopping and lawful purposes. These terms do not prevent uses permitted by law.

Rights and disputes

Nothing in these policies excludes mandatory consumer rights, liability that cannot lawfully be excluded, or remedies for unsafe or defective goods. We do not guarantee a particular health outcome. South African law applies, subject to mandatory protections applicable elsewhere. You may use competent courts, regulators or applicable dispute resolution bodies. There is no compulsory private arbitration requirement.

Contact customer service first if you wish us to resolve a problem. You may also approach the National Consumer Commission at https://thencc.org.za or the Consumer Goods and Services Ombud at https://www.cgso.org.za where the matter falls within its jurisdiction. Updated policies apply prospectively; changes do not remove rights under existing orders.

Returns cancellations and refunds

Last updated: 21 October 2026

How to request help

Contact us using the published email or WhatsApp number with your order reference and the problem. A photo, batch number or reasonable proof of purchase can help us investigate, but a photograph is not an absolute condition of exercising a legal right. Contact us for return instructions so we can arrange the appropriate route. Do not send goods to an unconfirmed supplier address.

Damaged incorrect or unsafe orders

Please report damage, incorrect goods, contamination or suspected spoilage promptly. Reporting within 48 hours helps investigation but is not a deadline that removes statutory rights. Stop using a product that may be unsafe, keep its packaging and batch information if available, and contact us. We arrange and bear reasonable return costs where we are legally responsible.

Defective goods

Where the Consumer Protection Act applies, goods that fail its quality standards may be returned within six months of delivery, without penalty and at our risk and expense. Subject to the Act, you may choose repair, replacement or refund. Misuse and ordinary wear are assessed under the law. Opening packaging does not itself remove a valid defect claim. A shorter shelf life does not excuse goods supplied unsafe, spoiled or otherwise noncompliant.

Online cancellation rights

Where ECTA section 44 applies, you may cancel without reason or penalty within seven days after receiving goods. Only the direct return cost may be charged; payments are refunded within 30 days of cancellation. Statutory exclusions may apply, including qualifying food and beverage deliveries, personalised goods and goods that cannot by their nature be returned or deteriorate rapidly. We explain any applicable exclusion before purchase rather than treating every herbal or personal care item as automatically excluded.

Other cancellation rights remain available where applicable, including ECTA rights following missing disclosures or an inadequate opportunity to review an order. The CPA direct marketing cooling off right applies where legally applicable, subject to its interaction with ECTA. Contact us promptly so we can identify the right applicable to your transaction.

Optional change of mind returns

Beyond mandatory rights, we offer no additional general change of mind return period unless expressly stated on a product listing or promotion. Any optional offer does not replace legal rights. A lawful hygiene or perishability restriction affects optional returns only to the extent permitted by law; it cannot be used to refuse a valid complaint about defects, safety or an incorrect order.

Refund method

Refunds are ordinarily made to the original payment method, unless another lawful method is agreed. We confirm the amount and processing date. Banking delays do not extend a statutory refund deadline. We do not impose store credit instead of a refund where you are entitled to a monetary refund. Any permitted deduction must have a lawful basis and be explained.

Delivery areas and charges

We deliver only to destinations enabled at checkout or expressly confirmed in a WhatsApp order. Delivery charges and any free delivery threshold are shown before payment. Collection is available only if expressly confirmed. Do not assume a local stock location from the appearance of a product photograph.

Delivery estimates

We currently deliver within South Africa. Processing and transit arrangements can differ between OUR PRODUCTS and supplier fulfilled items. Use the estimate shown for your item and delivery method at checkout, or request a written estimate from us before paying. Business days exclude weekends and South African public holidays.

Your checkout or written order summary gives the applicable delivery window. Where no other time is agreed, statutory fulfilment rules apply. If delivery is materially delayed, we will explain the available options and honour applicable cancellation and refund rights. If an item becomes unavailable, we notify you promptly and refund as required by law.

Tracking and split orders

Where tracking is available we provide it after dispatch. Supplier fulfilled orders may arrive in separate parcels with different estimates. Split delivery and any additional charge must be disclosed before payment or separately agreed. We remain responsible for resolving delivery issues for purchases from us.

Delivery problems

Provide an accurate address and an accessible contact number. If you discover an error, contact us promptly. We assess any necessary redelivery charge fairly and disclose it before it is incurred. Please tell us promptly about loss or damage. Our obligations and the point at which risk passes are governed by applicable law; we do not treat handover to a courier as automatically ending our responsibility.

International orders

International delivery is offered only when expressly enabled. Before accepting an order we disclose whether duties, import VAT and clearance charges are included or payable by the customer. We do not ship herbal products to destinations where their import or sale is prohibited. Cross border delivery remains subject to the mandatory consumer protections that apply to the transaction.

Privacy and cookies

Responsible party and information collected

La!ita – Herbal Vitalé operates this store. Send privacy requests to support@lalitashop.com, marked for the Information Officer. Our business contact details appear below. We collect your name, contact and delivery details, orders, correspondence, payment status and limited device and browsing information. Payment providers process payment credentials under their own security arrangements.

Why we use information

We process information for orders, delivery, support, returns, legal records and fraud prevention. Our lawful bases include contract performance, legal duties, legitimate interests subject to your rights, and consent where required. Required checkout fields support order fulfilment; without them we may be unable to supply the order. Optional marketing choices do not affect your ability to purchase.

Service providers and overseas processing

We share only information needed for the relevant task with our ecommerce host Shopify, selected payment providers, couriers, fulfilment suppliers and other authorised service providers actually used for your order. We may disclose information to authorities when lawfully required. Shopify privacy information is available at Shopify Consumer Privacy Policy. You may contact us for information about providers involved in your order.

If information is transferred outside South Africa, we use a lawful transfer basis and appropriate safeguards under POPIA. Suppliers receive only necessary fulfilment details. A purchase does not automatically enrol you in marketing by Easzy Market, TAYERI, AEMO or another business. Any additional sharing requires its own lawful basis and appropriate notice.

Marketing and WhatsApp

Promotional email, SMS and WhatsApp require a lawful basis, including consent where required. Any existing customer exception covers only our similar offerings and includes required objection opportunities. You can unsubscribe using the message link or reply STOP to promotional WhatsApp messages. We honour objections without charge. Essential order communications may continue. Enquiring about a product or giving us a phone number does not itself constitute unlimited marketing consent.

Sensitive information and security

Please do not send medical histories, identity documents or other sensitive details through ordinary chat unless specifically needed and a suitable secure process has been explained. Any necessary health information requires an appropriate lawful basis and additional safeguards. We use reasonable organisational and technical safeguards, restrict access and manage service provider obligations. No system is risk free. Security compromises are handled and notified as POPIA requires.

Retention and your choices

We retain information only for necessary business and legal purposes, then securely delete or deidentify it as required. Order and tax records are retained for applicable legal recordkeeping periods; enquiry records for the time needed to resolve the matter and any related dispute; security logs for necessary security purposes; and marketing records while the lawful permission remains valid, with limited suppression records retained to honour opt outs. You may request access or correction, object to processing where permitted, request deletion where applicable, or withdraw consent for future consent based processing. We may verify identity proportionately and explain any lawful retention requirement or permitted fee. Complaints may be submitted to the Information Regulator at https://inforegulator.org.za.

Cookies and tracking

Essential cookies support functions such as basket and checkout. Analytics and advertising technologies, where used, can collect device and browsing information to measure use and support relevant advertising. Where consent is required, optional tracking requires your consent. Use any cookie settings provided on this website or contact us for help managing your preferences and details of technologies used. Browser restrictions may affect store functions. Continued browsing is not blanket consent to tracking. Shopify explains its platform cookies at Shopify Cookie Policy.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy . Depending on where you live, you may exercise certain rights with respect to your personal information here Shopify Privacy Portal Link.

Children and external services

This store is intended for adults. If a child has supplied personal information, a parent or guardian should contact us so we can assess and address the request lawfully. External sites and social media services operate under their own privacy notices. We update this notice when practices change and give further notice where required.

Herbal product information and safety

Herbal product information and safety

Information and permitted claims

Our website provides product information and general wellness content. It does not provide an individual diagnosis or replace advice from a qualified healthcare professional. Read the current product label, ingredient list, directions, warnings, storage instructions and expiry information before use. Product specific instructions take priority over general website content, subject to applicable law.

We make only claims that are lawful and adequately supported for the specific product. We do not represent any product as SAHPRA approved, registered, clinically proven or a treatment for a disease unless that statement is accurate and legally permitted. Traditional use and customer experiences must be described accurately and must not be presented as proof of a guaranteed result.

Suitability and use

Herbal ingredients can cause allergies, side effects or interactions with medicines. Seek professional advice before use if you are pregnant or breastfeeding, take medication, have a medical condition, or are considering use for a child. Do not stop prescribed treatment on the basis of website content. Follow the product specific directions; do not exceed the stated amount or use a product by a route not described on its label.

La Tiba ointment is for external use only. Do not ingest it. Follow the product label concerning application, sensitive areas and other precautions. Do not use any product if the seal is unexpectedly broken, the packaging is damaged or the contents show suspected spoilage. Keep products out of reach of children and store them exactly as instructed.

Adverse reactions and complaints

Stop use if an adverse reaction occurs and seek appropriate medical advice; serious symptoms require urgent medical attention. Please notify us with the product name, batch number, expiry date, order details and a description of the concern where available. We handle safety reports sensitively, investigate with the relevant supplier and cooperate with competent authorities where required. Your legal rights remain unaffected.

Reviews and images

Customer experiences vary and do not guarantee the same result for another person. Reviews must be authentic and any incentives disclosed. Illustrative imagery is identified as such. We do not use disclaimers to justify misleading before and after images or unsupported medical claims. Natural differences in colour or texture do not excuse unsafe goods or a material difference from the description.

Product status

Do not infer SAHPRA approval or registration from a product being listed on this website. Contact us for information about the status of a particular product. Any required product disclaimer appears on its label or listing. Nothing on this page removes your statutory consumer rights.
